Terms and conditions - services contract with Incatourism



    1. - On the cost of services:

  • 1.1. - All prices are quoted in U.S. Dollars.

  • 1.2. - It should be taken into account that according to the legal norms (D.L. 919) of Peru, non-resident foreigners are exhonerated from paying the sales tax (IGV) of 18 % for the concepts of overnight stays and food in hotels, as long as their stay within the country is not longer than 60 days.

  • 1.3. - In compliance with that same legal norms, our website, doesn`t include the sales tax (IGV) for hotel reservations. Buyers who are not exhonerated of this tax will have to cancel this amount at their arrival at the hotel, with the hotel administration.
  • 1.4. - All rates of contracted services are subject to changes and space availability, to be confirmed on booking.
    2. - On the reserves in general:

  • 2.1. - The system will only process reservations received at least 1 day prior to the date of commencement of the services required.

  • 2.2. - To confirm the reservation, we must have received payment for services or through our online payment system.

  • 2.3. - The payments or deposits must be made through our online system. In the statement of your credit card charge will be recorded as BIZPAY.

  • 2.4. - Transaction Fee: All reservations are subject to a nonrefundable fee of $ 5.00. Our system acts as an intermediary between tourist service companies and users for the reservation process and payment of services. To ease the tourist services reservations we have trade agreements with several companies who manage their own booking and payment systems such as hotels and tour operators.

    3. - Reservations of tour packages and others:

  • 3.1. - All travel programs and tours that have been confirmed are guaranteed and insured. Otherwise the user should immediately contact Inca Tourism.

  • 3.2. - The requested booking confirmation will be sent through an e-mail with the reservation code for each requested tour package.

  • 3.3. - The confirmation of the services will be effective after receipt of verification of your online booking.

  • 3.4 .- The portions of the package or tour not used by the passenger, will not be refundable once the package or tour is running.

  • 3.5. - If you cancel any contracted service (Tours), the following cancellation fees will be charged:

    • Cancellations up to 30 days in advance, will be charged 25% of the total contracted amount.

    • Cancellations between 29 and 16 days in advance, will be charged 50% of the total contracted amount.

    • Cancellation of less than 16 days in advance, will be charged 100% of the total amount.

  • 3.6. - Cancellations will be received by e-mail with the subject "cancellation" and once made Inca Tourism will send a confirmation notice by the same means.

  • 3.7. - Any change of time, date or another, will be consulted with the service provider company after checking availability and the terms and conditions of each agency. The consultation will be possible only until 30 days before the date of commencement of the tour or contracted service.

    4. - Hotel Reservations not included in a package tour:

  • 4.1. - Any application for reservation of confirmed hotel accommodation is insured and guaranteed. Otherwise the user should immediately contact Inca Tourism.

  • 4.2. - The requested booking confirmation will be informed to you through an e-mail with the code of each hotel reservation requested.

  • 4.3. - The hotel rates only includes overnight accommodation, unless explicitly published and specified that it includes other services, such as for instance breakfast and airport – hotel transfer.

  • 4.4. - Passengers only have to show up at the reception desk of the booked hotel, show passport or identity card and mention the confirmation code, in order to be accommodated by the hotel.

  • 4.5. - The following cancellation charges will be applied in case of cancellation of a reservation:

    • Cancellations up to 30 days in advance, will be charged 25% of the total contracted amount.

    • Cancellations between 29 and 16 days in advance, will be charged 50% of the total contracted amount.

    • Cancellation of less than 16 days in advance, will be charged 100% of the total amount.

  • 4.6. - Cancellations will be received by e-mail with the word "cancellation" in the subject, and once managed, a confirmation notice shall be sent by the same means.

  • 4.7. - If the passenger does not show up at the hotel at the requested date and time, it will be deemed NO SHOW and hence, total nights booked will be non-refundable.

    5. - Responsibilities and obligations of Inca Tourism:

  • 5.1. - The obligation for services not provided due to the negligence of Inca Tourism, its staff, or service operators in the portal, will be limited to actual cost of services and excludes all consequences or indirect resulting costs. In this case, Inca Tourism will provide alternative arrangements of equal value, subject to availability.

  • 5.2. - No claim will be considered if made after 30 days of the end of the package or tour.

  • 5.3. - Inca Tourism, as an intermediary that advertises travel and accommodation programs, is responsible for verifying that services and accommodations offered are provided as declared in the program as posted on our web site.

  • 5.4. - Inca Tourism shall not be liable for failure to provide the services offered in case of adverse weather conditions, natural disasters, strikes or social problems which cannot be predicted or anticipated.

  • 5.5. - If the means of transportation (plane, train, bus) chosen by the passenger fails to arrive at the destination on the scheduled date and time, where the program or tour booked by the passenger starts, Inca Tourism and the Tour Operator are absolved from all liability for non-provision of reserved services. The tour operator will provide the service only from the corresponding portion when the passenger arrives. The non-used portion of the program is not refundable.

  • 5.6 .- Inca Tourism seeks to work with operators who provide quality services. Nevertheless, as an intermediary of tour operators, Inca Tourism denies all liability for loss, damage or injury sustained in connection with the services and/or accommodation provided by local tourism companies, tour operators, airlines, hotels and others. All of them operate under the laws of the country where these services are provided.

  • 5.7. - Inca Tourism is not responsible for loss of baggage or personal items of passengers during the tours or routes of travel. The responsibility of luggage is up to the respective owners. Small items such as video cameras or cameras, binoculars, bags, umbrellas, warm clothes, etc., will be completely under the care and responsibility of their respective owners.

  • 5.8. - It is recommended that all baggage be properly secured and have personal identification cards.

  • 5.9. - Our programs do not include additional insurance to those offered by carriers that provide mandatory insurance against accidents. Inca Tourism recommends to obtain insurance in the place of origin. We encourage travelers to hire a specific insurance. If the client prefers not to hire it, Inca Tourism is not responsible of paying any medical expenses or damages.

    6. - Confidentiality of information:

  • 6.1. - To make reservations for package tours or hotels and access to other services, the user is prompted to enter his/her personal details such as name, credit card number, among others, on a webpage specially designed for this purpose.

  • 6.2. - This personal information is confidential and will not be disclosed without client consent for any purpose other than strictly necessary to realize the commercial transaction requested by the customer.

  • 6.3. - Inca Tourism is not responsible for the use of this information made by any third party involved in the process of buying and selling travel packages and / or hotel reservations.
